Terms of Service

Terms governing the use of OctropsCode and this website.

1. Acceptance of Terms

By downloading, installing, or using OctropsCode (the "Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Extension.

2. Description of Service

OctropsCode is a free, open-source Visual Studio Code extension that functions as an autonomous agentic AI coding assistant. The Extension connects your editor directly to third-party AI provider APIs using your own API keys. It offers multi-provider model switching, RAG project memory, and 15 local workspace tools (file modifications, search, AST analysis, terminal execution). OctropsCode does not operate any backend servers or intermediary services.

3. License

OctropsCode is released under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the conditions of the MIT License.

4. API Keys and Third-Party Services

OctropsCode requires API keys from third-party AI providers to function. By using the Extension, you acknowledge and agree that:

  • You are solely responsible for obtaining and managing your own API keys
  • You must comply with the terms of service and acceptable use policies of each AI provider whose API you access through OctropsCode
  • You are responsible for any costs incurred through your use of third-party AI provider APIs
  • OctropsCode is not affiliated with, endorsed by, or responsible for any third-party AI provider

5. User Responsibilities

You agree to:

  • Use OctropsCode in compliance with all applicable laws and regulations
  • Not use OctropsCode to generate content that violates the acceptable use policies of the AI providers you connect to
  • Keep your API keys secure and not share them publicly
  • Review and approve side-by-side code diffs and terminal command executions prior to applying changes to your workspace
  • Take full responsibility for all code, content, file modifications, and shell commands executed in your environment

6. No Warranty

OctropsCode is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

The developers of OctropsCode do not warrant that:

  • The Extension will meet your specific requirements
  • The Extension will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Extension will be accurate or reliable
  • Any AI-generated code, file edit, or automated command will be correct, complete, or suitable for production use

7. Limitation of Liability

In no event shall the developers of OctropsCode be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Extension
  • Any errors, bugs, or inaccuracies in AI-generated content or automated workspace modifications
  • Unauthorized access to or alteration of your data or API keys
  • Actions or omissions of third-party AI providers
  • Any other matter relating to the Extension

8. AI-Generated Content & Autonomous Tool Execution

Code, file edits, and tool actions generated through OctropsCode are produced by third-party AI models operating autonomously via local workspace tools. You acknowledge that:

  • AI-generated code and automated file edits may contain syntax errors, breaking changes, or security vulnerabilities
  • You are solely responsible for reviewing, testing, and validating all code diffs and command executions before saving or deploying them
  • OctropsCode provides interactive diff modals and permission checks to assist verification, but makes no representations about the safety, quality, or accuracy of tool outputs

9. Intellectual Property

The OctropsCode name, logo, and branding are the property of destopianpirate. The source code is licensed under the MIT License. AI-generated content produced through the Extension is subject to the intellectual property policies of the respective AI provider.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be noted in the release notes and the "Last updated" date on this page will be revised. Continued use of the Extension after changes constitutes acceptance of the modified Terms.

11. Termination

Since OctropsCode is a locally-installed extension with no account system, there is no account to terminate. You can stop using OctropsCode at any time by uninstalling the extension from your editor.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of OctropsCode shall be resolved through good-faith negotiation or, if necessary, through the courts of competent jurisdiction.
